Performance Solutions secured today a preliminary injunction against PowX Inc. in a civil action pending in a Manhattan federal district court, PowX Inc. v. Performance Solutions, LLC, 24-CV-01389 (MMG). The preliminary injunction enjoins PowX Inc. from making, using, importing, offering for sale and/or selling PowX’s “Textured Foam Rollers for Muscle Massage” products, or any other identical or substantially similar product. The Court found that Performance Solutions is likely to succeed on the merits as to its claims of patent infringement, validity and enforceability and that it is likely to suffer irreparable harm by PowX due to its infringing activities.
